1. Acceptance of Terms

By downloading, installing, or using Untether ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Untether ("we," "our," or "us").

2. Description of Service

Untether is an AI assistant application for Garmin watches that enables you to interact with Google Gemini AI directly from your watch.

Service Models

Untether offers two service models:

Bring Your Own Key (BYOK) Model

  • Free download from Garmin Connect IQ store
  • Trial period to evaluate the app
  • You provide your own Google Gemini API key
  • API key is stored locally on your watch
  • One-time unlock payment processed via Stripe
  • You are responsible for all API usage costs with Google

Subscription Model (when available)

  • Free download from Garmin Connect IQ store
  • We provide managed API access through our backend
  • You create an account and subscribe for a recurring fee
  • Payment processed via Stripe
  • Includes usage limits based on your subscription tier
  • Starts with a free trial period with limited usage

You may choose which model to use based on your preferences.

3. BYOK Model Terms

3.1 Your Responsibility

When using the BYOK model, you are solely responsible for:

  • Obtaining and maintaining your own Google Gemini API key
  • All costs associated with Google Gemini API usage
  • Complying with Google's terms of service
  • Keeping your API key secure and confidential
  • Any content generated through your use of Google Gemini

3.2 No Access to Your Key

We do not have access to, store, or transmit your API key. Your API key is stored locally on your Garmin watch. We cannot and do not monitor or control your interactions with Google Gemini.

3.3 Third-Party AI Service

Your use of Google Gemini API is subject to Google's terms of service:

You acknowledge that we are not responsible for the performance, availability, pricing, or terms of Google's services.

3.4 Trial Period and Purchase

The BYOK version is distributed through the Garmin Connect IQ store as a free download with a trial period.

Trial Mode:

  • Download the app for free from Garmin Connect IQ store
  • Evaluate the app during the trial period
  • No payment required during trial

Unlock Purchase:

  • One-time payment of $4.99 (subject to change) processed via Stripe
  • Payment is required to unlock the app after the trial period
  • You will be directed to our secure payment page when unlocking
  • Refund policy available at the time of purchase
  • We do not store your credit card information (handled by Stripe)

4. Subscription Model Terms

4.1 Account Creation

When the subscription model becomes available, you will need to:

  • Create an account with a valid email address
  • Agree to these Terms and our Privacy Policy
  • Provide payment information for recurring billing

4.2 Free Trial

New subscribers may receive a free trial period with usage limits. Details will be provided at the time of subscription. Trial terms:

  • Limited number of requests per trial period
  • No credit card required for trial (when offered)
  • Automatic conversion to paid subscription requires explicit action

4.3 Subscription Plans

Subscription plans will include:

  • Usage limits (number of AI requests per billing period)
  • Access to multiple AI providers
  • Managed API access (we handle the keys)
  • Customer support

Specific pricing and limits will be displayed during signup and are subject to change with notice.

4.4 Billing and Payment

  • Subscriptions are billed on a recurring basis (monthly or annual)
  • All payments are processed through Stripe
  • You authorize us to charge your payment method for recurring fees
  • Prices are in USD and subject to applicable taxes
  • We do not store your credit card information (handled by Stripe)
  • We reserve the right to change pricing with 30 days' notice

4.5 Usage Limits

  • Each subscription tier has usage limits
  • We will notify you when approaching your limit
  • Exceeding limits may result in temporary service suspension until the next billing cycle
  • You can upgrade your plan at any time to increase limits

4.6 Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial billing periods
  • You retain access through the end of your paid period

4.7 Account Termination

We may suspend or terminate your account for:

  • Non-payment
  • Violation of these Terms
  • Fraudulent or abusive behavior
  • Excessive or unusual usage patterns suggesting abuse

5. User Responsibilities

5.1 Acceptable Use

You agree to use Untether only for lawful purposes. You will not:

  • Use the App to generate illegal, harmful, or abusive content
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use the App to violate any applicable laws or regulations
  • Share your account credentials or API keys with others
  • Use the App in a manner that could damage, disable, or impair our services
  • Attempt to bypass usage limits, security features, or access restrictions
  • Use the App to spam, harass, or harm others
  • Attempt to access others' accounts or data

5.2 API Key Security (BYOK Model)

You are responsible for maintaining the security of your API key. If you believe your API key has been compromised:

  1. Immediately revoke the key through your Google Cloud console
  2. Generate a new Gemini API key
  3. Update the key in the Untether app

We are not liable for any unauthorized use of your API key or resulting charges from Google.

5.3 Account Security (Subscription Model)

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

6. AI-Generated Content Disclaimers

6.1 No Accuracy Guarantee

AI-generated content may contain errors, inaccuracies, or hallucinations. We make no representations or warranties regarding:

  • The accuracy, completeness, or reliability of AI responses
  • The suitability of AI-generated content for any particular purpose
  • The appropriateness of AI suggestions or recommendations
  • The quality or performance of third-party AI services

6.2 Critical Decisions

Do not rely on Untether for:

  • Medical, legal, or financial advice
  • Emergency situations or time-critical decisions
  • Safety-critical applications
  • Navigation or situations where errors could result in injury, loss, or damage
  • Professional advice of any kind

Always verify important information from authoritative sources and consult qualified professionals for important decisions.

6.3 Your Responsibility

You are solely responsible for:

  • Evaluating the accuracy and appropriateness of AI-generated content
  • Any actions you take based on AI responses
  • Any decisions made using information from the App
  • Compliance with applicable laws when using AI-generated content

7. Intellectual Property

7.1 Our Rights

Untether, including the App's code, design, interface, and documentation, is owned by us and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for personal use only.

7.2 Your Content

You retain all rights to the prompts you input. However:

  • AI-generated content may not be eligible for copyright protection under current laws
  • Content generated by third-party AI services may be subject to their terms
  • We do not claim ownership of your prompts or generated content

7.3 Feedback

If you provide feedback, suggestions, or ideas about the App, we may use them without obligation or compensation to you.

8. Disclaimers and Limitations of Liability

8.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of uninterrupted or error-free operation
  • Warranties regarding the accuracy or reliability of AI-generated content
  • Warranties regarding the availability of third-party services

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or business opportunities
  • Damages arising from your use of third-party AI services
  • Damages arising from AI-generated content or your reliance on it
  • Costs incurred from third-party API usage
  • Service interruptions or unavailability
  • Data loss or corruption
  • Unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (a) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) $100 USD.

8.3 Third-Party Services

We are not responsible for:

  • Availability, performance, or pricing of Google Gemini or Garmin services
  • Changes to Google's API terms, pricing, or availability
  • Interruptions in third-party services
  • Data practices or security of third-party providers
  • Content, accuracy, or legality of AI-generated responses

9. Privacy

Your use of the App is also governed by our Privacy Policy, available at untether.watch/privacy. Please review it to understand our data practices.

Key points:

  • BYOK Model: We do not access your API keys or conversations
  • Subscription Model: We do not store prompt content or AI responses
  • Both models: We collect minimal usage data for service improvement
  • You can opt out of telemetry in app settings

10. Termination

10.1 By You

You may stop using the App at any time by:

  • BYOK Model: Uninstalling the app from your watch
  • Subscription Model: Canceling your subscription and uninstalling the app

10.2 By Us

We may terminate or suspend your access to the App at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activities
  • Extended periods of inactivity (subscription model)
  • Non-payment (subscription model)
  • Discontinuation of the service

10.3 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately
  • You must uninstall the App from your device
  • BYOK Model: Data stored locally on your watch remains until you delete it; no refunds for one-time unlock purchases
  • Subscription Model: We will delete your account data according to our Privacy Policy
  • Subscription Model: No refunds for prepaid periods
  • We are not obligated to provide refunds for terminated accounts

11. Changes to Terms

We may modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date
  • For material changes, we will provide notice through:
    • In-app notification when you next use the app
    • Prominent notice on our website
    • Email notification (if we have your email address)

Continued use of the App after changes constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the App.

12. Geographic Restrictions and Export Controls

  • The App may not be available in all countries
  • You are responsible for complying with local laws regarding use of the App and AI services
  • You may not use the App in violation of export control or sanctions laws
  • Some features or AI providers may be restricted in certain jurisdictions

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

13.2 Disputes

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Good faith negotiations between the parties for 30 days
  2. If negotiations fail, binding arbitration or courts in England and Wales

13.3 No Class Actions

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

13.4 Exceptions

Either party may seek injunctive relief in court for:

  • Intellectual property infringement
  • Unauthorized access or security breaches
  • Violations requiring immediate action

14. Miscellaneous

14.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.2 No Waiver

Our failure to enforce any right or provision of these Terms does not waive our right to enforce it later.

14.3 Assignment

You may not assign or transfer these Terms. We may assign these Terms to any affiliate or successor.

14.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Untether regarding the App.

14.5 Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including:

  • Natural disasters
  • War or terrorism
  • Internet or infrastructure failures
  • Third-party service outages
  • Government actions or regulations
